Terms and Conditions
Membership Eligibility and Application: Membership at MBYC is subject to approval by the club's management. Applicants must complete the membership application process and meet any criteria set forth by MBYC.
Membership Fees and Dues: Members are required to pay an initial membership fee and ongoing dues as specified by MBYC. Fees and dues are subject to change with prior notice to members.
Use of Club Facilities and Yachts: Members have access to club facilities and yachts as per their membership level and subject to availability. Members must adhere to all club rules and regulations while using club facilities or yachts.
Booking and Cancellation Policy: Yacht bookings must be made in advance. Cancellations or changes to bookings may incur fees or penalties as outlined in MBYC's cancellation policy.
Safety and Conduct: Members must follow all safety guidelines provided by MBYC. The club reserves the right to revoke membership for conduct deemed unsafe or inappropriate.
Liability Waiver: Members participate in all club activities at their own risk. MBYC is not liable for any injury, loss, or damage suffered by members or their guests, except where such liability cannot be excluded by law.
Guest Policy: Members may bring guests subject to the club's guest policy, which may include restrictions on number of guests and activities.
Membership Suspension and Termination: MBYC reserves the right to suspend or terminate membership for non-payment of dues, violation of club rules, or any negative behavior .
Changes to Terms and Conditions: MBYC reserves the right to modify these terms and conditions. Members will be notified of any significant changes.
Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the state in which MBYC is located.
Dispute Resolution: Any disputes arising under these terms and conditions will be resolved through arbitration or a small claims court, depending on the magnitude of the dispute.
Acceptance of Terms: By continuing membership at MBYC, members acknowledge and agree to these terms and conditions.
Refund Policy
Membership Fee Refunds: The initial membership fee is non-refundable except as specifically provided in these terms or required by law.
Dues Refunds: Membership dues are generally non-refundable. In exceptional circumstances, such as long-term illness or relocation, the club may consider partial refunds at its discretion.
Yacht Booking Cancellations:
Cancellations made more than [specified number of days, e.g., 14 days] before the booking date will receive a full refund of any booking fees paid.
Cancellations made within [specified number of days] of the booking date will incur a [specified percentage, e.g., 50%] cancellation fee.
No refunds will be provided for cancellations made less than [specified number of days, e.g., 48 hours] before the booking date, except in cases of emergency or extenuating circumstances, subject to the club's discretion.
Event and Program Refunds: For special events or programs requiring additional fees, refunds will be governed by the specific terms and conditions set out for each event or program.
Refund Process: All refund requests must be submitted in writing. Refunds will be processed to the original payment method within [specified number of days, e.g., 30 days] of approval.
Changes to Refund Policy: MBYC reserves the right to modify this refund policy at any time. Any changes will be communicated to members in a timely manner.
